ABC posted a story today about wedding photographers getting sued for using copyrighted music, here is the link:

Related to this is a December 7th blog in daredreamermag.com regarding a photgrapher getting sued.

For those that believe using copyrighted music (or any copyrighted material, for that matter - just ask Ron) and being sued is a small risk (me included), it might be time to revist the subject matter once again. Not trying to scare anyone, but for those doing it for fun or earning a living, any lawsuit could take a big bite out of any profit and enjoyment received.

That sort of goes along with video taping parts of the wedding (reception) where music is played and using portions of that in the larger project. Many photographers doing that will eventually be squashed too. Even though the music was being played by the DJ and not the photographer/videographer, it was still "recorded". I would imagine it would still be considered copyright infringement if it's posted online on YT where tons of people can see it.

What I'd be concerned about too is a customer copying a private use DVD slide show and THEY posting the digital file on YT. I imagine the person who created the slide show/video could be named in the lawsuit even though they may have used the customer's music and gave it all back to them and didn't post it on YT.

Glad I've chosen to not do weddings.

PS - I speculate that this also is one of the reason's Photodex has moved away from promoting user shows on the Photodex website and are doing it via Facebook and YT. Those social websites have better means to deal with the person using copyrighted music that posted the video and keeps Photodex out of it, legal wise. They just yank the video or at least have the means to flag it.

PPS - Here are a couple of sites the photographer who got sued uses for all this stuff now. Hadn't known about these yet but might be good source for ProShow users. Build the cost of the music license into your service and pass it on to the customer in the price of your product.
